Litigation

Case Submission

O. If applicable, from the left-hand navigation bar select the Litigation link.

1. Select “+Add Litigation

2. Select the litigation “Type” from the drop-down box

3. Select the current litigation “Status” from the drop-down box

4. Enter the litigation “Status Date” by entering the date (MM/DD/YYYY) or selecting the date by clicking on the calendar icon

5. Select “Yes” or “No” to indicate whether or not the litigation affects the subject property

6. Select “Yes” or “No” to indicate whether or not the litigation affects title or limits valid transfer/conveyance of title

7. If you inadvertently add a litigation and need to remove, select the “Delete” link by the applicable row to remove subject litigation

8. To add additional litigation select the “+Add Additional Litigation” link and then enter all details for each additional litigation by following steps 2-6 noted above

Recommended Next Step: Case Submission

P. Submit the Non-Delegated Manual Submission to Fannie Mae: Once you have entered and reviewed all the data and are ready to submit the case click the Create Manual Submission button.

Q. Case Submission will result in the one of the following:

  1. Successful Case Creation: If the non-delegated manual submission is successfully submitted to Fannie Mae then you will receive a “Case Sent to Fannie Mae” message, and the case status will reflect “Awaiting Review”. “Awaiting Review” means the case has been placed in Fannie Mae’s queue for review.

  • Note: The case status will change as it moves through the subsequent steps of the review process:
    • An “In Review” status means the case is being reviewed by an HRS Representative.
    • ​​​​​​An “Approved for Trial” or “Declined” status means the case has been decisioned by an HRS Representative. The HRS Representative will email their recommendation and applicable details to the person who submitted the non-delegated Manual Submission for review.

  • Note: To view the case details select the View Case Details link next to “Approved for Trial”.

  • Note: To view the case data elements used to create the non-delegated manual submission select the View link next to “Manual Submission Data”.

  • Note: A message in red will appear when you next enter the loan in the SMDU UI: “This version of case information is not the latest and will be updated with the most current information.” which indicates changes have been made by a Fannie Mae Representative and all you need to do is select “Dismiss”.

2. Unsuccessful Case Creation: If the non-delegated manual submission is not successfully submitted to Fannie Mae then you will receive a validation error message highlighted in red at the top of the page, and you will need to review the message and take appropriate measures to clear the error.

  • Note: In the screenshot above the message is letting you know that you need to update borrower’s income. Once updated you will need to reselect the “Create Manual Submission” button to resubmit your case request to Fannie Mae for review.
